Terms of Service

WUBBERY PTY LTD ("WUBBERY", "we") operates wubbery.com, the WUBBERY console, the public proof endpoint, and the hosted gateway at api.wubbery.com. These terms apply to anyone who uses any of them. Creating an account means accepting these terms, the Privacy Policy and the Acceptable Use Policy; that acceptance is recorded with the document versions, your email and the time.

Going live (paid use) is governed by the Customer Agreement and the Data Processing Addendum, which you accept separately in the console before a card goes on file.

WUBBERY measures, and when you go live acts on, what your existing compute and AI traffic could cost instead. Your requests are sent to the Provider you configured, using your credentials; that Provider answers and bills you. WUBBERY does not resell inference, does not hold your Provider's money, and never selects a Provider you have not configured.

• Shadow mode observes your traffic, serves every request exactly as you pinned it, and records beside each one what WUBBERY would have done and what that would have cost. It is free, changes nothing, and spends nothing.
• Live mode lets WUBBERY act on those answers, only ever within the models you have approved for that key, and never one you have not. If WUBBERY is unavailable, every request goes to exactly what you sent, unchanged.
• The console shows both columns, WUBBERY off and then on, on your own traffic, and is where you switch between modes.

Every figure on wubbery.com is a pair, WUBBERY off and then on, measured under the condition printed beside it: population, budget, seed, machine. Figures are measured on our hardware, on seeded or replayed traffic, and reproduce from the public proof endpoint. They show what has been achieved. They are not a prediction of what will be measured on your traffic, and no dollar figure on this site is a quote. The only figures that ever appear on an invoice come from your own ledger.

• You must give a working email and keep it current; notices go there.
• You keep your password, tokens and keys confidential and are responsible for use under your account until you tell us a credential is compromised, after which we revoke it.
• If you act for an organisation, you confirm you may bind it.
• One person, one account, unless we agree otherwise. Accounts are not transferable.

• Use the service lawfully and in accordance with the Acceptable Use Policy and your Provider's terms.
• Supply valid credentials for each Provider you route through, and pay that Provider for what it serves.
• Do not reverse engineer, probe, or attempt to derive the Engine's methods, models or thresholds, and do not use the service to build a competing one. Reproducing the published figures from the public endpoint is expressly permitted.
• Review outputs and approve any external action before it is taken on your behalf. WUBBERY changes what the work costs; it does not change what your software does with the answer.

What is stored, for how long, and what is never stored is set out in the Privacy Policy and, for personal data inside your traffic, the Data Processing Addendum. The short version: prompts and responses pass through in memory and are never stored; the ledger keeps timestamps, models, tiers, token counts and prices; learned state is per account and never pooled.

Everything in the Engine, the gateway, the console, the documentation and the published figures, including all methods, models and improvements, belongs to WUBBERY PTY LTD and its licensors. You receive a non-exclusive, non-transferable licence to use the hosted service for your own business while you have an account. Feedback you give us may be used without obligation. Any self-hosted or on-premises deployment is by separate written agreement.

We operate the service with reasonable skill and care. Because an unavailable WUBBERY changes nothing about where a request goes, an outage stops the saving, not your traffic. We may change or withdraw features; we will not reduce, without notice, the protections that shadow mode changes nothing, a request never goes to a model you have not approved, and prompts are never stored.

• Except as expressly stated, the service is provided as is, with no warranty that it achieves any particular saving, is uninterrupted, or suits a particular purpose.
• Nothing here excludes any guarantee, right or remedy under the Australian Consumer Law that cannot be excluded. Where our liability for breach of such a guarantee can be limited, it is limited to re-supplying the service or paying the cost of re-supply.
• To the extent the law allows, neither party is liable for loss of profit, revenue, data or goodwill, or indirect or consequential loss, and our total liability in any 12-month period is limited to the fees you paid us in that period (which, for a free account, is nil).
• Nothing limits liability for fraud, wilful misconduct, or breach of the reverse-engineering or data clauses.

You may close your account at any time in the console. We may suspend or close an account that breaches these terms or the Acceptable Use Policy, or that we must close to comply with law, and we will tell you why unless the law or a security investigation prevents it. On closure your tokens are revoked at once and stored data is handled as the Privacy Policy describes.

We may update these terms on 30 days' notice by email. A new version carries a new version number, and the console records your acceptance of it. If you do not accept, you may close your account before the change takes effect.

• Governing law: Victoria, Australia; the parties submit to the courts of Victoria.
• Notices: email, to the address on your account and to the notices address on this page.
• You may not assign your account; we may assign these terms to a successor of our business on notice.
• These terms, the Privacy Policy, the Acceptable Use Policy and, once accepted, the Customer Agreement and Data Processing Addendum are the whole agreement about the service.
• If a clause is unenforceable it is read down or severed and the rest continues.
